Small Business Legal Issues

Running a small business can be a legal minefield, and without appropriate knowledge and understanding of the relevant risks involved, you can quickly find yourself in serious legal difficulties. Running a small business without consideration for the law is dangerous, particularly when considering the potential financial and even criminal risks you may be running. That’s why it’s a good idea to have an idea of the relevant legal provisions that may apply to particular circumstances in order to understand where you might be personally liable, and how you can avoid incurring such liability when running a small business.

The first thing to bear in mind is that running a small business has its own legal formalities relating to the particular business form you choose. For example, running your business as a sole trader will require very little in the way of natural legal formalities, other than that you file appropriate tax returns annually and that you keep appropriate records of your financial transactions on a daily basis. That burden is far more strict if you choose to operate as a limited company, and if you do choose this option it may be worth investing in a book on basic company law in order to keep you in check. Don’t take the risk and try to muddle through – it’s better to know what’s expected of you and what the penalties are by getting some form of expert opinion.

Secondly, there may be liability faced if you cause injury, either financially or physically to another party in the course of running your small business. A good way around this may be to include an exemption clause, or disclaimer, although it’s important to understand these aren’t watertight. What they can do is limit your liability in damage to physical property where it is reasonable to do so, and in no way can they limit any liability you may have for anything deemed unreasonable or anything relating to a physical injury or death. It is advisable therefore to opt for insurance coverage to protect against eventualities of this nature.

It’s a criminal offense as a small business director to trade when you are aware that your business is insolvent. This is a general proposition, and there are obviously intricacies involved, although as a general rule this must be protected against and you could receive a criminal record if you breach these laws. Similarly it’s a criminal offense not to take records of your finances and to hold on to those records for three years, and you’re open to inspection of those records by the relevant authorities. This might also be compounded by legal requirements under the VAT regime, where you will be required to keep more rigorous accounts and are with certainty subjected to periodical inspections of your premises.

There are a number of key legal provisions you should be aware of as a small business owner, and they are far too numerous to list here. Rather than spending fortunes on legal advice, a better option is to purchase a beginners’ guide to company law, to give you an insight into the practical requirements of running your business on a day to day basis, then topping up that resource with legal advice as and when required.

Ethical Issues in Nursing

People in every field are confronted with ethical issues of some kind. However, these ethical issues become high in magnitude and extent when public officials are involved. An industry like health and medicine holds ethics in highest regard due to the involvement of human life. Oftentimes, health care practitioners like doctors and nurses face ethical dilemmas in their professional lives. Although, they are often trained to manage issues of this kind, sometimes, they can have lasting impact on their professional and personal lives. The general awareness among masses regarding their rights during a medical procedure often conflicts with the morals of this industry. This article focuses on some current ethical issues in nursing.

Ethical Issues in Nursing Practice

Consent and Capacity
The Patient Bill of Right adopted by American Hospitals Association states that “a patient possesses the right to be informed of the medical consequences of his or her actions and decisions and refuse treatment to the extent permitted by the law”. However, this is true only if the patient is in position to understand the consequences of his treatment. Incompetent, senile patients neither have the correct judgment regarding which treatment is appropriate for them, nor are they in a state of understanding the implications of their treatment. In such case, their willingness to grant or deny consent cannot dictate the course of treatment.

Even in case of mentally sound patients, the families of the patients often fail to understand that doctors and nurses are experts about their health than themselves. Denying consent to an effective treatment can cause a patient his life. This issue is becoming graver by day as the population of ailing, aging individuals continue to rise. These individuals are often in a state where they cannot think for themselves and have no one to do it for them.

Confidentiality and Autonomy
This is another ethical issue erupting from the conflict of patient’s rights and professional ethics in nursing job and profession. The Patient Bill of Right makes it mandatory for the medical practitioners to reveal the form and extent of the ailment along with the course of treatment to be undertaken by the practitioners. However, this law of autonomy clashes with the nursing ethic that the professional should maintain high degree of confidentiality regarding the patient’s health and treatment.

In certain situations, the patient and his family may not grasp the full consequence of the information provided by the nurse. This may unnecessarily lead to misunderstandings and panic. Although, there is no harm in informing most of the families, some of them are better kept in dark for the interest of patient.

Non-Compliance on Part of Patient
Oftentimes, some patients seek repeated treatments for the same condition again and again. They end up getting admitted in different hospitals for same condition, without much improvement in their health. More often than not, these treatments options are sought at the expense of tax payers money. In normal circumstances, this is not a problem as every patient has a right to receive best possible treatment for him. However, when the practitioner finds out that the issue is self induced, his personal opinion may cloud his judgment regarding the treatment given to such patient. It is unfair to spend taxpayer’s money for the treatment of an individual who knowingly inflicts damage upon his own health. This is one of the biggest ethical dilemmas faced by the nurse practitioners.

Ethical issues in nursing industry are somewhat similar to those faced by physicians and other health care providers. Ethical issues in nursing research may be more specific in nature.

Issues Facing the Nurses and Nursing Profession

Nurses are one of the most in-demand health care practitioners in the world. Studies show that the nursing profession exceeds the limit of the human mind and body. For this reason, it is not surprising that the profession is faced with various problems that seem to have little or no solution. Medical facilities and hospitals are taking this information under serious consideration; making reforms in the practices and distribution of work load to properly address the issues.

Nurse shortage

There are approximately 2.8 million registered nurses in the United States alone and yet, it is faced with shortage problems. In the US, 30 states are suffering due to shortage problems based on a study that was conducted. Very big percentage of health care facilities lacks the medical staff to provide basic health care. As a result, health agencies refuse new admissions out of their will. The shortage in nurses has been a problem since the Second World War but it has only been in the recent years that it started to affect the quality of the healthcare services in significant ways.

Reasons for nurse shortage

One of the major reasons for the shortage is the job dissatisfaction. Most nurses are stressed out because of the frequent changes in the schedule, work overloads, shifting work schedules, and the lack of appreciation by superiors and colleagues. The steep population growth demands an increase in the health care services.

Aging in the nursing workforce is a big contributing factor to the problem. The people entering the profession are getting fewer and fewer, causing the average age of nurses to rise. Many experienced nurses are nearing or reaching the age of retirement and there are not enough new nurses for replacement.

In the United States–and other developed countries– the number of students enrolling and graduating from Nursing is on a continuous decline. This is also due to the fact that the number of nursing educators is dropping; causing universities and colleges to refuse admission.

Globalization provided career opportunities for both men and especially women. As a result, the women of today seek out employment in other fields besides nursing. People are weighing their options in search of a career that provides a worthy compensation and the opportunity to enhance the quality of life. Many are seeking careers in the field of medicine, law, and the corporate world that offers lucrative, competitive and attractive compensations.

Impact of nurse shortage

The shortage affects both the developing and developed countries. The direct effects on nurses include the increased work load for nurses. Nurses handle more patients than they are capable of therefore increasing the risk of human errors due to lack of focus. Turnover rates are increasing as well as the risk of the spread of diseases and infection to the patients and staff. Shortage also increases the risk of work related injuries and deaths.

The perception that nurses work with unsafe working conditions eventually leads to more shortage that affects local and national recruitment efforts. Most importantly, the increased amount of work increases the level of stress for nurses and in turn increases chances of seeking psychiatric help.
