Loss Mitigation, Subprime Loans and Loan Servicing

Mortgage lenders originated subprime loans on an increasingly frequent basis between 2001 and 2005. In order to generate business and compete in an over exuberant market, lenders became more flexible with product offerings and asset. These loans not only represented a financial opportunity, but also much higher risk for default. According to industry statistics, subprime lenders originated about one in five residential mortgage loans, yet foreclosure rates on subprime loans are ten times the average for all others. Consequently loss mitigation has become the new loan solution with government regulatory agencies now mandating that mortgage servicers offer loss mitigation programs to help borrowers avoid foreclosure.

Loss Mitigation Programs

The primary objective of loss mitigation is to reduce or minimize potential losses incurred by the servicer, investor and borrower. Make no mistake about it; the investor will take the path of least financial loss. In other words, if there is equity in the property and the investor can recover some of their loss, they will foreclose and resell the property before agreeing to a modification of terms. It should also be noted that the rise in NOD and foreclosures is a nationwide problem and reaches beyond subprime loans. Loss mitigation options are needed for the entire spectrum of asset grades — from A, to Alt-A and subprime. Communication is Key

Borrowers are sometimes difficult for lenders and/servicers to contact after they have gone late on mortgage payments. This is because many of them are scared, embarrassed or simply don’t what to do when faced with the possibility of losing their home. Services now have sophisticated modeling tools that can help them predict the likelihood of a borrower defaulting on their existing loan. The data model is a collection of credit bureau information that is used to evaluate rising consumer debt on credit cards, auto loans and other obligations and the correlation between that and recent late payments to any of those creditors. The results of the analysis will vary, but lenders must take a much more proactive course of action to prevent future foreclosures by assisting borrowers earlier in the process. The key is to stay in touch with the borrower. If a borrower expresses an interest in keeping the property and an ability to make payments, demonstrate a hardship that caused problem, verify there is no equity in the property (property is worth less then what is currently owed on the note) and that a reduction in rate and/or principle will solve the crisis, there is a strong chance that a loan modification will be successful.

Servicers proactively following up with subprime borrowers earlier can mitigate financial loss for both investors and homeowners matching borrowers with the loan modification options that offer the best chance for successful results.

Loss Mitigation Options

This is a new paradigm in the mortgage industry. Servicers must learn to shed old habits associated with collecting a debt and shape new views and strategies that will allow borrowers to remain in their homes with payment plans that fit a well documented budget. There are a number of loss mitigation options available to help keep subprime borrowers in their homes, generate cash flow and eventually bring their loans current. These include modifications, repayment plans, repayment plans that convert to modifications and special forbearance plans.

A candidate for a loan modification is generally someone who has experienced a hardship which is now over, and he or she has the ability to pay a monthly mortgage payment, but not necessarily the payment originally assigned to the note. The loan modifications often times include forgiving a portion or all of the delinquency, or restructuring it so that it is paid over time.

Trial Attorneys Take on Loss of Consortium in California

There is an eclectic system in each state concerning the “Loss of Consortium” laws. However, most of the state’s jurisdictions give permission to wives and husbands of those who have been victims, usually in a personal injury case, to recover damages due to loss of consortium.

This is actually a form of “non-economic damage” wherein a partner in a domestic partnership or marriage may be given special rights to recover compensation after the other partner has been a victim of wrongful death or severe personal injury.

This means, that aside from the actual victim’s pursuance of a personal injury case against the parties liable for the accident or defective products he/she had been involved in or taken that resulted in severe injuries, the victim’s spouse, if the jurisdiction permits it, can also sue the liable parties. The spouse’s case would be a claim for compensation on the loss of consortium he/she suffered that resulted from the victim’s injuries.

The usual legal action done in cases of loss of consortium comes from the uninjured spouse. He/she will file a case against the defendant for damages consequential from his/her inability to enjoy or feel the same warmth and companionship she had enjoyed or felt before his/her spouse sustained injuries. These kind of legal claims usually arise whenever a spouse become severely injured, even killed as an aftermath of another party’s wrongful/intentional acts and/or negligence.

The Basics

The conventional wisdom regarding loss of consortium is the losses that are suffered by the other spouse that results to the limited or decreased sexual activity after the injury of the other.

Realistically though, more implications are covered by this term. The damages sought to be compensated by an uninjured spouse is centered on the aftereffects of the injury on spousal functions that previously existed between the partners.

Given this, aside from deprivation or limitation in sexual relations, the claimant spouse who filed loss of consortium usually bids for compensation for the deprivation or loss of the following:

- Emotional care and support
- Companionship
- Affection
- Domestic services (e.g. caring for the small children, share in household chores)
- Love
- Comfort
- Society

These are among the terms covered in filing a loss of consortium claim, connoting that there are broader matters concerning this clause.

Damages

Since damages because of loss of consortium are non-economic, there is no defined monetary loss in this kind of cases. The claim also has no tangible cash value. As such, in cases that involved claims for loss of consortium, the jury or judge are given the discretion to determine the award to be given to the victim in case such claim has been established.

Loss of consortium in California

In California, a loss of consortium claim has a prerequisite of valid marriage. A court in California declared that absence of a valid marital relationship means that no such right exists.

Moreover, instructions to a California jury have explicit definitions of the loss of consortium, which is the “loss of [the spouse's] love, companionship, comfort, affection, society, solace or moral support; any loss or enjoyment of sexual relations or the ability to have children or any loss of the [the spouse's] physical assistance in the operation and maintenance of the home…”

” In its article entitled, “Tai chi,” the Mayo Clinic staff at MayoClinic.com stated that preliminary research shows that practicing Tai Chi regularly may not only reduce anxiety and depression, but also increase bone mineral density after menopause. This was echoed by a report in http:

This is a very important finding, and begins to make even more sense, when you consider the National Institutes of Mental Health reports that the stress hormones found in depressed women caused bone loss that gave them bones of women nearly twice their age. Exactly why Tai Chi offers such benefit may be explained by a study from Australia’s La Trobe University that found that Tai Chi reduced levels of stress hormones more effectively than some other forms of activity. But, no matter how you slice it, research is indicating that Tai Chi may be a “very” effective multi-level beneficial therapy for women. A Chinese study reported in the December 2004 “Physician and Sportsmedicine” found that tai chi could retard bone loss among postmenopausal women significantly. Bone mineral density was measured before and after the study period. Both groups experienced general bone loss, but the rate of bone loss for the Tai Chi group was less than in the control group.
